Hironori Kubota has extensive experience with a wide range of cross-border legal matters, particularly litigation, intellectual property and regulatory matters on behalf of Japanese clients doing business or investing in the United States.

Before joining Zuber Lawler & Del Duca, Mr. Kubota served in a variety of legal and executive capacities at Yamaha Motor Co., Ltd. and Yamaha Motor Corporation, U.S.A. for more than 17 years, including supervision and coordination of all legal matters throughout the United States.  He last served as Vice President, Secretary and Treasurer of Yamaha Motor Corporation, U.S.A.

Mr. Kubota has extensive subject matter expertise in industrial robotics as well as automotive technology, including engines, outboard motors, recreational vehicles, motorcycles, all-terrain vehicles, personal watercraft and snowmobiles.  His in-depth understanding of relevant technologies as they relate to clients’ business objectives enables Mr. Kubota to contribute to the development of sophisticated, cost-effective solutions to high-stakes intellectual property and product liability disputes.

Notable Representations

  • A series of patent enforcement actions for a transnational automotive technology company in both federal court and before the International Trade Commission concerning a portfolio of dozens of patents in connection with personal watercrafts.  A very favorable settlement was reached.
  • A patent infringement litigation relating to snowmobile seat structure, resulting in a summary judgment of non-infringement in favor of the client;
  • Nationwide mass product liability actions, including federal multidistrict litigation proceedings in the Western District of Kentucky.  Coordinated proceedings in Georgia and Judicial Coordination Proceedings in California relating to side-by-side off-road vehicles.  The cases were successfully resolved, resulting in multiple defense verdicts.
  • An anti-dumping action before the International Trade Commission relating to outboard motors manufactured by Japanese manufacturers, resolved in favor of the client.
  • A trademark infringement case against a Chinese manufacturer and its U.S. distributor in federal court relating to trade dress for all-terrain vehicles resulting in permanent injunctions issued against the manufacturer and distributor.
  • Numerous asset and stock acquisitions of U.S. technology and manufacturing companies.
  • Transfer pricing and advance pricing agreement issues involving U.S. and Japan-based parties.
  • Financial services agreement matters.
