Kevin I. Shenkman

Counsel

Kevin Shenkman is experienced in handling a wide variety of litigation matters, and specializes in intellectual property law, particularly patent litigation, prosecution and licensing.

Mr. Shenkman has handled some of the largest disputes involving patents and copyrights in recent history. Mr. Shenkman has extensive experience in all aspects of intellectual property law, including litigation of patent, copyright, and trade secret matters, the successful prosecution of patents, and licensing; and in other types of civil litigation. Mr. Shenkman is experienced in all aspects of litigation – from drafting the complaint to being lead counsel at trial.

In the fields of intellectual property litigation, Mr. Shenkman has led the enforcement of patents, including obtaining a successful settlement and licensing of a patent to several entertainment-based companies. Mr. Shenkman has also successfully licensed and enforced numerous patent portfolios relating to, among other things, digital media transmission, computer docking stations, and database searching. In the copyright arena, Mr. Shenkman was part of the team that defended the leading distributor of peer-to-peer software, in the most notable copyright case of the last twenty years – MGM v. Grokster – which was decided by the United States Supreme Court. Mr. Shenkman represented the only defendant in the case that did not lose on summary judgment or agree to shut down its operations.

Mr. Shenkman’s litigation practice also extends to handling antitrust matters with billions of dollars in dispute, legal malpractice, and construction litigation. For example, Mr. Shenkman was part of the team that successfully defended antitrust litigation relating to the Skype VoIP protocol, and successfully prosecuted one of the largest legal malpractice cases arising from a patent prosecutor’s conduct in enforcement litigation. With his engineering background, Mr. Shenkman has also been successful in various construction litigation matters and contract disputes of a technical nature, including winning summary judgment for an engineering firm in a contract action, and more recently obtaining a fraud verdict and punitive damages for another client at the close of trial in February 2009.

Mr. Shenkman has also used his litigation skills to protect several pro bono clients from injustices that arose from their lack of financial resources – for example, representing tenants in unlawful detainer actions, and alleged debtors in collection actions.
