Litigation
Zuber & Taillieu attorneys have been involved in such matters as:
- various patent infringement matters regarding the filing of ANDAs to make the generic version of a pharmaceutical drug.
- obtained finding of inequitable conduct against a plaintiff at trial over patents directed to angioplasty catheters and medicated stents.
- represented a medical device manufacturer in a patent infringement and trade secret misappropriation lawsuit regarding spinal cord stimulation systems and implantable drug pumps.
IP Protection

- managing all IP protection and patent litigation for a major multinational medical device research and development company.
Our Attorneys
- Patrick Del Duca, selected for inclusion in the 2010 and 2011 editions of THE BEST LAWYERS IN AMERICA®, has assisted businesses in the medical and healthcare industry with corporate, commercial and financial challenges. He is experienced in the launch, maturation and exit of such businesses, having, for example, assisted respectively in the acquisition of rights to a portfolio of biotechnology from The Regents of the University of California, the acquisition of a heart valve medical device manufacturer, and a US$1.9 billion genetically-engineered pharmaceutical exit. Trained in common and civil law, he has worked domestically and widely across borders, especially in Europe and Latin America.
- Josh Lawler has counseled large public medical device companies in investments into, joint ventures with, and acquisitions of, industry target companies; and represented medical device and healthcare oriented companies in a variety of transactions including licensing of intellectual property, company finance and management agreements. Mr. Lawler holds a degree in biopsychology with a certificate in genetics from Duke University.
- Thomas F. Zuber has over a decade of experience representing clients in the health care industry, for example, including in regards to invasive medical devices, photoelectrochemical devices, genetically engineered food and online business methods. Mr Zuber holds a degree in biomedical engineering from Rutger’s University.
- Eric F. Galen has over a decade of experience advising clients in the health care industry. Mr. Galen has managed all aspects of federal and state regulatory compliance and health care transactions, and is adept at risk assessment of joint ventures and other business arrangements under federal and state fraud and abuse and self-referral laws, licensing application processes, drafting hospital and medical staff bylaws and rules and regulations, CMS issues, and the formation and governance of health care entities, medical groups, management companies and “friendly PCs.” Mr. Galen has provided legal services for clients such as leading hospital groups, medical device manufacturers and physician organizations.
- Raymond C. Sun has worked as in-house counsel at a leading multinational medical device research, design, and manufacturing company. Mr. Sun is familiar with technology relating to stents, catheters, oxygenators, grafts, heart valves, filters, and other such devices, as well as the relevant patents. Mr. Sun is experienced in organizing and managing patent portfolios as well as patent litigation relating to medical device technologies.
- Sarah S. Brooks holds a degree in biology from Tufts University and worked for several years as a research technician at Massachusetts General Hospital and Children’s Hospital Boston. Ms. Brooks has extensive experience in pharmaceutical patent litigation, and is knowledgeable about FDA rules and regulations relating to both NDAs (New Drug Applications) and ANDAs (Abbreviated New Drug Applications).
- Benjamin C. Deming has a substantial background in medical device patents, and has been involved in defending patent infringement claims relating to implantable medical devices, such as angioplasty catheters, stents, and implantable spinal cord stimulation devices.
