Zuber Lawler & Del Duca Obtains Critical Trial Ruling in Power Plant Investment Dispute in Tanzania
Zuber Lawler & Del Duca represents VIP, a prominent Tanzanian holding company, in a litigation relating to an investment in a power plant before the High Court of Tanzania. With claimed damages of $500 million, the litigation is the largest case in the history of the Tanzanian courts. At commencement of trial, defendants Standard Chartered Bank, Wärtsilä and Mechmar Heavy Industries attempted to exclude key factual and expert evidence. Zuber Lawler & Del Duca partner Chris Provenzano led counterarguments on behalf of VIP. After argument, the Court entered a critical ruling siding with Mr. Provenzano, admitting all of the offered evidence, and allowing counsel to proceed to examine the principal fact witness.
In a related matter, Mr. Provenzano led representation of the client in a $75 million sale of the investor’s interest in the power plant while the project was in winding-up proceedings, returning the plant to a condition in which it could operate under a power purchase agreement with the Tanzanian government.
